Age verification in Brazil

I know there is a lot of polemic with new(er) laws regarding restricting content to minors and or verifying age to allow or not access to certain online contents

I don`t know how California or NY laws are about this, but brazilian new laws pretty much "exempt" opensource projects for the obligation of having this kind of thing

I used commas because one thing = Big distros that are supplied by big vendors like Canonical can have verification because Canonical has resources to do it

Different than small distros and forked versions

The law pretty much says about the proportionality and financial capacity of software, services, social network and gaming companies to have verification like this

And regardind Chapter IV that regulates the age verification it says in Art 12 that age verification should be proportional to the capacity

The owner of the project Midnight BSD is a weak push over with no spine that is already committing age verification framework to his OS even though they aren't required to. My assumption is that they are probably being paid privately to do this. Best to abandon this project, find another BSD project that still cares about privacy/freedom, or fork your own.

I had someone reach out regarding assistance in implementing the ID checks in Brazil. I'm not sure how I feel about this yet. I responded to them to get more info on what that would entail.

I'm not comfortable complying with ID verification in any jurisdiction.

One concern I have is that I don't know when I'd suddenly be out of compliance with this. If we always stay small and don't become a commercial entity, there's no issue. If we ever want to offer support services or I want to turn this into a full-time gig, well, I might be blocked from doing that. At this point, it's probably unlikely.

I've had a number of people contact me about Brazil. A lot of folks are upset about the ban. I've also had a lot of folks trashing me for even trying to work on the california compliance. It's really a no win situation for open source projects.

The only thing I can say right now is that things are fluid on this. If other folks want me to open up brazil in some capacity, and have CONSTRUCTIVE comments, please share here.

But as I said I dont know if CA and other US states laws consider the proportion part But here smaller distros dont have the obligation if suppliers don`t have financial ability

i have huge respect for open source developers and community overall, so read next message with this in mind.
about constructive comments: maybe try not to blindly comply with all laws that are created but instead question them and at least try to oppose the first? For example, system76 is trying to oppose it first, so write to them, "ask how can i help?"
get in contact with agelesslinux - they are literally opposing EVERY possible law, learn something from them
there is a lawyer that wants to help to oppose such laws

overall good research is done by KickSecure team here
and there is example of what NOT to do
And probably many more people fight back and oppose such laws in general, so i suggest you to at least try to oppose, then blindly follow laws. <3
